This document is for purposes of regulating the BASIC CONDITIONS OF MEMBERSHIP of the Europoint Programme for the Fuerte Hoteles' Friends Club, which offers accountholders the opportunity to earn Europoints when reserving rooms or using other services provided by Fuerte Hoteles, as specified.
By becoming a member of the programme, the user agrees to abide by the following Terms and Conditions without reservations and acknowledges the validity of each and every one.
Without prejudice to the foregoing, Fuerte Hoteles reserves the right to modify these General Conditions at any time, duly notifying Friends Club members of any such changes.
1. Among other things, Fuerte Hoteles may: change the ability to win, redeem, limit, modify or cancel any prize; cancel or change the prizes of its commercial partners; increase the number of Friends Club Europoints required to redeem any prize; change the categories of hotel prizes; modify or regulate the transfer of points or Friends Club benefits; add restriction dates on hotel prizes; or limit the percentage that can be redeemed and applied toward any and all destinations.
2. Fuerte Hoteles will not be held liable for damages caused by commercial partners that withdraw from the Friends Club Europoint programme, for changes in their services or for Friends Club cancellations resulting from their withdrawal from the programme.
3. Fuerte Hoteles' Friends Club will remain active until such time as Fuerte Hoteles, in its sole discretion, decides to designate a termination date for the programme. Fuerte Hoteles' Friends Club reserves the right to terminate the points programme at any time. In such an event, Fuerte Hoteles will provide written notice to all currently active members two months in advance. "Active member" signifies any member who has earned Europoints from Fuerte Hoteles' Friends Club within the past 12 (twelve) months. A Friends Club member may be suspended at Fuerte Hoteles' sole discretion if he or she has not earned any Europoints for a period of 12 (twelve) consecutive months. All of the member's Europoints from Fuerte Hoteles' Friends Club will be forfeited at that time.
4. Europoints will remain valid for a period of 12 (twelve) months from the date they are earned, signifying the date they are credited to the user's account. Upon completion of this twelve-month period, Fuerte Hoteles' Friends Club may deem the points to be expired at any time without the necessity of notifying the programme member. Likewise, Fuerte Hoteles' Friends Club may suspend a member's participation in the Europoint programme without prior notice if the member fails to pay hotel invoices in a timely manner or if he or she appears to be using the programme in any way that violates the Terms and Conditions or the intended purposes of the programme, including, without limitation, payment of a percentage of the invoice using Europoints.
5. Fuerte Hoteles' Friends Club may suspend the account of any member who acts in an abusive manner or in any way that otherwise violates current legislation. In the event that an account is suspended, all accumulated Friends Club Europoints will be forfeited.
6. The sale or barter of Europoints, hotel prizes, prizes provided by commercial partners or Friends Club benefits is strictly prohibited, except when transacted on the part of Fuerte Hoteles. Any Europoints, hotel prizes, commercial partner prizes or Friends Club benefits that have been transferred, sold or assigned in an unauthorised manner may be seized or cancelled.
7. In the event that a hotel or resort ceases to operate under Fuerte Hoteles or any other hotel brand that is owned, administered, operated, franchised or licensed by Fuerte Hoteles, its affiliates or its subsidiaries, Friends Club Europoints will not be earned on reservations in that hotel or resort, including when the reservation has been made prior to the termination date.
8. In the event of the documented death of a Fuerte Hoteles' Friends Club member, the programme Europoints may be transferred to the co-account holder, or in the absence of a co-account holder, to a person sharing the same residential address as the deceased.
9. A member may not have more than one Fuerte Hoteles' Friends Club account. Companies, associations and groups are prohibited from registering as members of Fuerte Hoteles' Friends Club.
10. For purposes of this document, the term "Fuerte Hoteles" refers to all the hotels of the Fuerte Hoteles chain, as well as the hotel establishments that make up part of Fuerte Hoteles' business group, unless otherwise specified. Likewise, the term "commercial partner of Fuerte Hoteles" refers to the establishments of various types with which Fuerte Hoteles' Friends Club associates in order to provide benefits to its members.
11. Privacy policy: the personal information of our clients is maintained electronically for purposes of promoting the lodging, catering, leisure and real estate services of the companies of the El Fuerte Group, under the direction of Fuerte Group, S.L. (Hotel Fuerte Marballa, Avda. El Fuerte s/n, 29602 Marbella).

You hereby expressly authorise El Fuerte Group to share this information among the companies within the group for the above mentioned commercial purposes and for providing more personalised service.
12. APPLICABLE LAWS AND JURISDICTION
The Basic Conditions of Membership are not severable and shall be interpreted and applied in accordance with Spanish legislation. In the event of any disputes arising from the interpretation and application of these General Conditions, the parties expressly renounce any corresponding jurisdiction and expressly agree to submit themselves to the jurisdiction of the Courts and Tribunals of Marballa (Malaga).
