The aim of this present document is to regulate the BASIC OPERATIONAL CONDITIONS FOR MEMBERSHIP of the Friends Club €points program, which offers its members the possibility of earning €points when they use accommodation or other aforementioned services provided by Fuerte Hoteles.

Anyone who becomes a member of the program must fully and completely accept the validity of each and every one of the operational terms and conditions that are listed below.

Notwithstanding that shown above, Fuerte Hoteles reserves the right to modify these General Conditions, and members will be properly informed of any modifications.

1. Among other things, Fuerte Hoteles can: change the requirements for earning, withdrawing, limiting, modifying or cancelling any awards; cancel or change awards for business partners; increase the Friends Club €points required for obtaining any award; change the award categories of the hotels; modify or regulate the transfer of Friends Club points or benefits; add limit dates for awards in hotels or limit the percentage of the amount that can be exchanged at any or all of the destinations.
2. Fuerte Hoteles does not accept responsibility for any business partners that withdraw from the Friends Club €points program, for changes to the service or for cancellations of Friends Club €points as a result of said withdrawals.
3. The Friends Club program will continue in force until such a time when the Friends Club decides, at their complete discretion, to designate a date for the termination of the program. The Friends Club has the right to terminate the points program. Two months written advance warning of termination will be given to all active members. An “active member” is defined as a member who has received Friends Club €points within the previous 12 months. A Friends Club member can be suspended at the discretion of Fuerte Hoteles if they do not earn any Friends Club points for 12 consecutive months. All the €points from their Friends Club account will be lost at this moment.
4. Without prior warning, the Friends Club can suspend a member’s participation in the €points program if they do not pay their hotel bills on time, or if they appear to be using the program in a way that does not coincide with the Terms and Conditions or with the program’s intentions that include, but are not limited to, the use of €points to pay a percentage of a bill.
5. The Friends Club can suspend the account of any member that acts in an abusive or unlawful way. If an account is suspended, all accumulated Friends Club €points will be lost.
6. The sale or exchange of €points, awards from hotels or from business partners, or Friends Club benefits, with the exception of operations carried out by Fuerte Hoteles, is totally prohibited. Any €points, awards from hotels or business partners or Friends Club benefits that have been transferred, sold or assigned for this purpose can be confiscated or cancelled.
7. If a hotel or resort ceases to function as part of Fuerte Hoteles, or any other hotel brand that is owned, administered, operated, franchised or licensed by Fuerte Hoteles or its affiliate or subsidiary companies, no Friends Club €points will be awarded for stays in this hotel, even if the reservation is made before the termination date.
8. In the case of a documented death of a Friends Club member, the program’s €points can be transferred to the joint account holder or, in their absence, to a person who resides at the same address.
9. Only one Friends Club account can be held per member. Companies, associations or groups cannot register for the Friends Club.
10. Unless otherwise specified, the term “Fuerte Hoteles” as used in this document refers to all of the hotels that belong to the Fuerte Hoteles chain, along with the hotel establishments that form part of the business group that Fuerte Hoteles is part of. The term “Fuerte Hoteles business partner” as used in this document refers to any type of business establishment that the Friends Club is associated with in order to provide benefits to its members.
11. Confidentiality policy: personal data relating to our clients will be held in an automated system and used for the marketing of accommodation, restaurant, leisure and property services provided by companies belonging to the El Fuerte Group. The company Fuerte Hoteles S.L. has overall responsibility for this group (Hotel Fuerte Marbella, Avda. El Fuerte s/n, 26602, Marbella).

    I expressly authorise the El Fuerte Group to pass this data on to companies belonging to the same group, for the aforementioned marketing purposes and to receive a better personalise treatment.
12. APPLICABLE LAW AND JURISDICTION
    The Basic and Operational Conditions form a single unit and shall be interpreted and applied in accordance with Spanish legislation. To solve any issue that may arise in relation to the interpretation and application of these present General Conditions, the affected parties will expressly renounce any jurisdiction that may apply to them and they will expressly submit themselves to the jurisdiction of the Marbella Courts and Tribunals (Malaga).
